An Anambra State High court sitting in Awka, has adjourned to Tuesday February 21, 2023, the bail application for Mr Sunday Muoghalu, Septuagenarian charged with alleged rape and defilement of underage girl, resulting in pregnancy.

The accused, was earlier docked on a 3-count charge before an Amawbia Magistrates’ court for offences bothering on rape, unlawful intercourse and abuse of fundamental rights among others of a 13-year-old girl.

The prosecuting officer, Inspector Ayogu Onyema had told the court that the defendant was arrested by security operatives at his Agu Oye Umudioka  residence following a tip-off and thereafter arraigned.

According to him, the accused allegedly committed offense is punishable by Section 34 law of Anambra State 2004. 

But the accused pleaded not guilty after the charges were read in court, insisting he was not responsible for the pregnancy.

In her ruling, Senior Magistrate Osakwe, opposed the bail application brought by the counsel to the accused, Mr Ifeanyi Neonwu on the ground that he has no jurisdiction and binded the case to High court and thereafter adjourned the case to February 1, 2023 for transfer of the case.

When them matter came up at  the High court presided over by the Chief Judge of Anambra State, Hon. justice  Onochie Anyachbelu, after hearing the submission of the Counsel to the accused for Moughalu’s bail application brought before the court, the judge adjourned till Tuesday February 21 for ruling on the pending application.
