The Presidential Election Petition court has dismissed the Allied Peoples Movement (APM’s) petition seeking the disqualification of the Vice President of Nigeria, Kashim Shettima bothering on alleged double nomination ticket that produced him and president Bola Tinubu in the 2023 presidential election.
The court gave the verdict on Wednesday while delivering judgement on the suit by the and held that the petition ought to have been filed at the federal High court instead of the PEPC, which it said has no jurisdiction to hear the suit.
The Presidential Election Petition chairman, Justice Haruna Tsammani, stuck out the petition for ‘been incompetent and abuse of court processes’ in the suit that challenged the eligibility of Shettima on 25th February 2023.
The PDP had challenged Shettima’s dual nomination for Borno Central Senatorial District and Vice Presidential Candidate of the All Progressives Congress, which the petitioner claimed was in gross breach of the provisions of Sections 29(1), 33, 35 and 84(1) and (2) of the Electoral Act, 2022, as amended and prayed the court to nullify Tinubu’s and Shettima’s candidacy who both ran on joint ticket of the APC.
The duo was declared winner in the election by the Independent National Electoral Commission (INEC), and accordingly sworn into office on May 29, 2023 for a four-year tenure.
