Judge’s withdrawal puts Kanu trial on cliff hanger

The withdrawal of Justice Binta Nyaku, the presiding judge in the trial of Nnamdi Kanu, the leader of Indigenous People of Biafra on Tuesday at the federal High court in Abuja, put the case on cliff hanger in the temple of justice.

At the resumed Court session, Justice Nyaku recuse herself after the accused who has being trial for alleged terrorism case instituted against him by the federal government, stated that he has no longer have confidence in her handling the case.

He accused the trial Judge of failing to abide by the Supreme Court decision when the apex Court questioned on where Kanu’s alleged broadcast, which the federal government is charging him on was recorded.

The outburst he expressed in the Courtroom came after Counsel to federal government, Gboyega Awomolo informed the court that he was ready for the trial.

But, Alloy Ejemako, Counsel to Kanu, prayed the court to adjourn the case for his Client more time to prepare his defence.

Suddenly, interrupted his Counsel in an oral application, drew the attention of the court to a Supreme court ruling, which questioned the jurisdiction on where the alleged Kanu’s broadcast that was adduced as evidence against him was made.

Thereafter accused the judge of failing to abide by the apex court decision, stating that the refusal by the Department of State Security Service (DSS) was understandable, but the federal High court refusal to obey the ordes of Supreme court was regrettable.

After listening to Kanu’s and other submissions by parties in the suit, Justice Nyaku announced to the court that she has recuse herself from the case as demanded by Kanu and sent the case file to the Chief Judge of the State for reassignment.

During his interview with journalists after the court session, viably angry Kanu, justified his action, saying that, “the cherry picking from what is contained in this document is what I am against.

“It should be implemented holistically.
I am not against the trial. After all, I am innocent of the charges against me. There cannot be any trial when key sections of the Constitution and a Supreme court judgement has been violated by a court of law”, Kanu said ahead of a reassignment of his case by the Chief Judge of FCT federal court.
