Court orders DSS to grants IPOB leader, Kanu access to doctors

Court orders DSS to grants IPOB leader, Kanu access to doctors

A federal High court, Abuja Division, has invoked an order of Mandamus, directing the State Security Services (DSS) and its Director General, to grant Nnamdi Kanu, the detained Indigenous People of Biafra (IPOB) leader, unrestricted access to his medical doctors.

Recall that Kanu who was charged with treasonable felony, terrorism and other related offences, is being detained in Department Security of Service (DSS) custody in Abuja, after he fled Nigeria, and rearrested and thereafter deported abroad to Nigeria where he is facing his trial since 2021.

On Wednesday, the court presided over Justice Binta Nyako granted the reliefs while ruling on an application vide Suit No: FHC/ABJ/CS/2341/2022, filed by Kanu’s legal team.

Ifeanyi Ejiofor, Esq., IPOB’s Lead Counsel in a statement, explained that the ruling borders on the need for urgent medical attention to Kanu.

The application, according toEjiofor, was argued by Mike Ozekhome, SAN who led the team of lawyers in the well-considered ruling, which granted leave for judicial review in the form of order of Mandamus, compelling the State Security Services, and its Director-General to allow Mazi Nnamdi Kanu UNHINDERED ACCESS to his medical doctors.

The Lead Counsel to IPOB leader, revealed that the order would “enable them conduct an INDEPENDENT EXAMINATION of his present deteriorating health condition as earlier ordered by the Honourable Court on the 2nd day of October, 2021”.

According tl him, “His Lordship also granted leave for an order of mandamus compelling the State Security Services and its Director General, to provide Mazi Nnamdi Kanu with ALL HIS MEDICAL RECORDS, from the 29th Day of June, 2021, when he was remanded in the custody of the DSS, till date”.

“This application, is aimed at ensuring that the DSS will not hide under any indiscretion to treat with levity the deteriorating health condition of Onyendu Mazi Nnamdi Kanu”, Ejiofor said.
